"... We believe that states have an obligation to provide services to
people
with disabilities in the most integrated setting appropriate to their
needs.
And we have used the law to fight for this. Many individuals with
disabilities are being placed in nursing homes or other institutional
settings even when they don't really need to be there."

"... But some states don't understand what I've been talking about and
they
refuse to make reasonable modifications in their policies that would
allow
this to happen. They deny people with disabilities from receiving
community based services under already existing state programs.

That is why we have argued that the ADA's integration mandate should be
applied in these situations.

We say reasonable steps should be taken to provide services in the
community where that is the appropriate setting for the individual.
I am happy to report that the only two courts of appeal to address this
issue have agreed with our reading of the law." ...
